By creating an account or using KodaAI, you agree to these terms. Please read them carefully.
1. Acceptance
These Terms of Service ("Terms") govern your use of KodaAI, including the desktop application, web application, and API (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Account registration
You must be at least 13 years old to create an account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at hello@kodaai.dev if you suspect unauthorised access.
3. Subscriptions and billing
KodaAI offers a Free plan and a paid Pro plan. Paid subscriptions are billed in advance on a monthly or annual basis. You authorise us to charge your payment method on the applicable billing cycle. All prices are in USD and exclusive of any applicable taxes, which are your responsibility.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are governed by our Refund Policy.
4. Acceptable use
You agree not to:
- Use the Service to generate, distribute, or store content that is illegal, harmful, or infringes third-party rights
- Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use
- Share your account with others or resell access to the Service
- Use automated tools to interact with the Service in a way that places unreasonable load on our infrastructure
- Circumvent any rate limits, access controls, or usage restrictions
We reserve the right to suspend or terminate accounts that violate these rules.
5. AI-generated content
KodaAI uses third-party AI models (including Anthropic's Claude) to generate lessons, challenges, feedback, and explanations. This content is provided for educational purposes and may occasionally be inaccurate or incomplete. You are responsible for evaluating any code or advice before applying it in a production context. KodaAI is not liable for errors in AI-generated content.
6. Intellectual property
KodaAI and its original content, features, and functionality are owned by KodaAI and protected by applicable intellectual property laws. You retain ownership of any code you write in the editor. By using the Service, you grant us a limited licence to process your code and messages solely to provide the Service to you.
7. Privacy
Our collection and use of personal data is described in our Privacy Notice, which forms part of these Terms.
8. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any particular educational outcome will be achieved. Use of the Service is at your own risk.
9. Limitation of liability
To the fullest extent permitted by law, KodaAI and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account at any time for violations of these Terms, with or without notice. You may delete your account at any time from account settings or by emailing us. Upon termination, your right to use the Service ceases immediately.
11. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation first. If that fails, disputes will be submitted to binding arbitration or the courts of competent jurisdiction.
